Legal cases are often lengthy, protracted and not something to be entered into lightly. This article looks at why it is Essential to find a solicitor as soon as you think you have a case and some of the things you should look for when choosing a solicitor to help through the process.

If you do have a case, see a solicitor as quick as you can- strike while the iron is hot.Solicitors will not take on every case, despite what you may of heard. If you consult a Lawyer, but they feel that you do not have a case, or it is so weak that success may be unlikely, then they will tell you, so that you do not waste your time progressing a case that is doomed for failure.

You should be able to get a free interview or a response by email.  Here the solicitor will tell you whether or not you have a legal case and it is worth proceeding.

So there is little point in just thinking about whether you have a legal case: you need to ascertain the facts. You must be aware there are timescales to the length of time after an incident when you can open a case.

Finding a solicitor should also be about finding someone that you feel confident and at ease with. If you have an initial meeting with a solicitor, but you don’t seem to gel or communicate easily with them, then simply find another solicitor.  They will be the person to fight for your rights, so there has to be a basis of trust and understanding there.

And don’t forget that a good solicitor will pay for themselves many times over, so as soon as you think you have a case, do not delay: see a solicitor and find yourself a good one!

Finding The Right Solicitor To Handle A Clinical Negligence Claim

Tuesday, February 9th, 2010

META: With so much at stake in Clinical Negligence Claims and the medical institutions likely to take any action necessary to prevent your case from succeeding, you certainly need to instruct a specialist solicitor in such cases.

Think again, if your are under the impression that any solicitor is capable of handling your criminal negligence claim! It is imperative, that you find an experienced, affiliated firm of solicitors, when making a claim of this nature.

Circumstances, is the centre of clinical negligence claims. This makes this, more so than any other area of law extremely sensitive for any claimant. Claimants place all of thier trust, even before the claim has arisen, into the medical professional who undertakes care of them. We are persuaded to trust this profession more so than any other and it can be absolutely devastating when something goes wrong and we are of the opinion that the medical professional’s duty of care towards us, has been breached in some way.

Such breaches of duty of care can give rise to clinical negligence claims, especially if the patient concerned has been affected seriously enough by the negligence to have suffered pain or loss in some way that would not have arisen otherwise. A specialist clinical negligence solicitor would need to become involved at this point. So you need to search until you find a solicitor that is right for you.

It would be very unlikely for any ordinary person to have enough legal knowledge or even the strength to be able to deal with this type of case on their own, especially as, clinical negligence claims normally are surrounded by bureaucratic minefields. Medical institutions rely upon public funds and they will do almost anything they can, within the law, to ensure that your case is unsuccessful. This, for any claimant, is in itself, very stressful.

This is when a specialist solicitor, in this field, is crucially required to negotiate a way through all of this ‘red-tape’ and to progress the case to a hopeful settlement for damages (compensation) at the very end. Finding a solicitor is imperative to your case. You must be prepared for a long-winded fight as getting there is likely to take you some time. If you have suffered as a result of clinical negligence, however, you must remember that you have every singly right in law to seek financial compensation for any pain or loss that you may have suffered as a result. All too often, medical professionals who are involved get away with their negligence, due to the fact that claimants lose sight of this crucial factor and feel they have to back down.

When searching for a clinical negligence specialist solicitor you should check to make sure that members of the firm belong to AVMA (Action for Victims of Medical Accidents), APIL (Association of Personal Injury Lawyers), or to the Law Society’s Clinical Negligence Panel. Moreover, verify if the firm holds a franchise with the Legal Services Commission for Legal Aid.

You will be able to relax more once you have checked that the firm you have chosen has really good credentials as you will know your case is being handled by professionals. Before instructing a solicitor to go ahead with your case, make prior enquiries as to who will be dealing with the legal matters throughout, as you do not want to find out that it has been passed to a junior member of the team. You might find this kind of representation on a solicitors directory.

You can find a reliable and good firm of solicitors by searching the online databases. Here you will find previous clients opinions of each firm of solicitors. This is an ideal way of deciding whether or not a firm is right for you as here, you can see previous comments that clients have made on the service they have received.

How Do I Know What Questions To Ask When I Initially Instruct A Solicitor

Sunday, September 27th, 2009

META: It can be difficult to choose the right solicitor to help with your case when they all tend to promise you the earth at the beginning. Hopefully some guidance is contained in this article for you.

Finding a solicitor to take on your case can be a very daunting task. Instructing, not to mention, the right firm for your job. A clear criteria and expectations of your relationship with your solicitor, at times like this usually a good thing to have. Start by approaching local solicitors in your area.

Obviously and rather annoyingly, when you first set out to find a solicitor you need to find the right one for your case you are likely to find that all firms will be tending to promise you the same levels of service. In fact, between most firms you will find it very difficult to place a pin. Advertising their services as if they are simply the best is something that all firms of solicitors are very good at doing. They will make you feel as though your’s is the only case they will be dealing with and your initial communication with most solicitors will be aimed at securing your instructions. However, it is at these times when you need to be the most cautious, keep a very open mind to their usual ‘flannel’ and pose questions to them which will endeavour to ascertain how likely they are to provide you with the very best level of service for your case.

If you are promised absolutely everything at your consultation, then it might be worth ignoring certain parts, as it is very unusual for most solicitors to adhere to these promises! Instead, ask them if the case is likely to be delegated to a less senior solicitor or, worse still, a member of staff with no formal legal qualifications, as definitely sometimes happens. It will be up to you to ascertain how truthful you feel the response is here, if you feel that they are squirming rather uncomfortably, you have your answer.

Most importantly, get them to set the merits of your case out in their own opinion. Ask them how they are going to deal with your case and get them to set it out clearly so that you fully understand every last detail. In other words, get them to stipulate how likely it will be for you to go on and win your case. Before they take your case on, solicitors will access your chances of success, especially if you are applying for legal aid.

The progress of your case is something that will be pretty important to you, so get them to stipulate what actions are necessary. It’s crucial here to listen very carefully as their response will determine as to whether or not you instruct them for your case.

Find out how the solicitor will aim to keep you updated on the progress of the case and make them stick to this. At this point, state to them that before going ahead you need to consider this. Losing faith in the solicitor can be pretty normal in this area, as they are not very good communicators and at times can be ignorant.

Trying logging on to the impartial reviews about solicitors online. That way you will see if the solicitors you have chosen are right for you. Solicitor.info is one such uk solicitor directory, where you will find accurate and up-to-date information on what previous clients have thought about different solicitors. With the knowledge of this information, you will be in a better predicament to select the right solicitor for your case.

A Clinical Negligence Claim And Finding The Right Solicitor To Handle It

Friday, September 18th, 2009

META: Medical institutions will do anything within their power to ensure your case does not succeed, this is due to the fact that there is so much at stake. This is why you will need to instruct a solictor who is specialist to this area for your case.

A solicitor who is qualified in criminal negligence needs to handle your claim, so think again, if you were under the impression that anyone could do it! When it comes to making a claim of this nature, it is imperative that you seek out legal representation from a firm of solicitors whom have the necessary experience and affiliation.

More so than with most other areas of law, clinical negligence claims are centred around circumstances that are of the most highly sensitive nature, for any claimant. Before the claim would have arisen, the claimant would have placed all of their trust into the medical professional whom had undertaken their care.

A clinical negligence specialist solicititor, at this point, would need to become involved. So you need to search until you find a solicitor that is right for you.

Clinical negligence claims are often thwart with bureaucratic minefields throughout and it would be highly unlikely for an ordinary citizen to be either strong enough or in possession of sufficient legal knowledge to be able to handle such litigation alone. Medical institutions rely upon public funds and they will do almost anything they can, within the law, to ensure that your case is unsuccessful. This, is very stressful, that’s for sure, for any claimant.

A good settlement for the damages caused to yourself is hoped to be achieved by the end. This will of course only be achieved if you have a specialist solicitor who is prepared to work their way through all the ‘red tape’ and to progress the case appropriately. Finding a solicitor is imperative to your case. You must be prepared for a long-winded fight as getting there is likely to take you some time. You have every single right in law, to seek financial compensation compensation for any pain or loss that you have suffered as a result of clinical negligence.

If you verify such credentials, you will be able to relax more, safe in the knowledge that your case will be handled by such professionals. However, before you do go ahead and instruct such a firm, ensure that your case will be handled by such an affiliated professional at all times and not delegated to a more junior member of the team. You might find this kind of representation on a solicitors directory.

Solicitors Who Offer A Free Initial Consultation

Saturday, September 12th, 2009

META: Many firms of solicitors will offer at least a half hour free initial consultation, although this may only be via telephone. Finding that firm that offers the services you require is the first step; secondly you need to look at what information you would like to ascertain from them?

Most firms of solicitors will provide potential clients with the facility to call them and take advantage of at least half an hour’s worth of free advice. However, is this helpful? Not as much as you might think. The half an hour slot will often be an assessment of you as to the other way around, as they like to determine whether your not your case is worth taking on. This type of situation unfortunately , shows how many solicitors are able to twist the situation to their own advantage.

With this in mind, it is always far more helpful if you can find a solicitor that will offer you a face-to-face free consultation. Such a firm, that being said, may not be in your area. Firms in larger cities are more likely to offer this service, as there tends to be more competition in these areas.

If you are able to visit the offices yourself, you are usually more likely to be able to decide whether or not you feel the specific firm will be the right choice for you. This way, you can meet the solicitor who will be dealing with your case face-to-face. It is quite nice to know who will be representing you throughout your legal matter.

If you are only able to secure an over the telephone free consultation, it is important to remember that this is YOUR opportunity to ascertain whether or not you wish to instruct them and not just theirs. Solicitors will tend to dominate the full half hour session, as they are trying to determine business for themselves; you must stop this if you can and find out the information you need. If you let them, that is. Use this time, instead to focus on your situation, after all the free consultation is for your benefit.

Of course you will have to set out the merits of the case, but you don’t have to take all day over this. Then move on to finding out the costs to you, if you are likely to go ahead and instruct them. Get the charges set out in writing from the firm of solicitors prior to signing up with them. This will save any surprises further down the line. How they intend dealing with your case and the cost of each element are questions you should be asking your solicitor.

If you do not like the way in which your free consultation has gone, do not be afraid of declining this firm of solicitors’ service. Finding the right solicitor to meet your needs is out there; you just need to find them and I have to say, there are plenty of them.

Another very helpful tool in finding a solicitor can be found in accessing databases which contain unbiased reviews of the service previous clients have received. Firms that get away with offering a poor service can be really annoying, so this to you is invaluable. Solicitor.info is one such site that will be of definite assistance to you in this regard. You can also access the solicitors directory.

How Do I Know Which Solictor To Turn To When I’ve Suffered A Personal Injury?

Saturday, August 22nd, 2009

You should show extreme caution where Personal injury law is concerned. After investigation, we found that many organisations have jumped on this lucrative band wagon since legal aid was abolished in this area in 2000.

Most of us may be able to recall having been stopped in the street, by some enthusiastic individual, to enquire whether we had had a personal injury within the past three years. Saying ‘yes’ meant that we had to listen to a convincing pitch designed to hook you into the relevant litigation from a target driven salesperson.

The abolishment of legal aid funding in 2000, has unfortunately meant that a number of companies have well and truly jumped onto this very lucrative band wagon. In fact, this industry represents a very lucrative market, and firms of solicitors can stand to make some healthy profits over what was originally, your misfortune.

The unsuspecting client, all too often, will not have a clue what they are signing themselves up for. The level of service you will receive from your chosen firm of solicitors will be very difficult to decipher and you may well ask yourself if all the stress was worth it; even if you are lucky enough to be awarded compensation at the end of it all.

Dealing with this area of law does not mean that every organisation is the same. On the otherside, Companies which offere an essential service in this regard can be found. Filling this empty void that was left by the government at the start of this millennium certainly helps.

It is practical and sensible to be careful as to who you can trust, however. Don’t just fall for a well delivered sales pitch, as these are often the types of organisations which should be avoided at all costs. Obtaining the correct level of justice for the pain and suffering you have experienced is not really top concern for these companies. Instead, they will be looking at you and seeing great big pound signs. With this in mind, be careful!

Carrying out your own research to identify a reliable firm of solicitors is a good idea. For this type of litigation, most firms will offer a no win no free contract so do not sign up for any firm that expects you to pay extorionate amounts of money.

Use a reliable solicitors directory which will reveal how people have rated past services. By doing it this way, and choosing your own solicitor means you will be able to avoid the ones which are known at providing a poor service.

One good example of a UK solicitor directory that offers helpful and impartial advice is solicitor.info. This venue allows you to literally screen the firms within your area and to trust the solicitor with the most positive reviews.

No Legal Aid Law Firms In My Area: What Can I Do?

Sunday, August 2nd, 2009

If people are unable to find a solicitor or legal aid then sometimes they will just forget it. This article discusses what can be done in these circumstances.

If you live in a part of the country where there are very few UK law firms, let alone firms that take on legal aid clients, it may seem as though there is no help available to you. In such circumstances, all too often, people literally fore go their entitlement to receive justice and this is absolutely wrong. You should be able to get legal advice free of charge in certain areas of the law.

It is so unfortunate that legal advice and representation is so much more readily available to those who have the money to pay for it. This only goes to prove that justice is only available to the rich.

The main thing that we wish to communicate in this article is that there are options available to you when you are unable to find a solicitor. If the case would involve something very important then this is even more important if you could not find a solicitor. Criminal law, employment law, family law, housing law and debt advice are just some examples of the areas of law where you will be able to make use of Community Legal Services national help lines.

This service is provided through the LSC (legal services commission) and if you qualify you will get help.

The Legal Services Commission are looking to take more and more work away from individual law firms over the coming years. Despite the fact that they are actually trying to keep this quiet. This is because it is much more cost effective for them to concentrate legal aid provision in single centres, where advice and representation can be provided via phone and post and at a fraction of the cost.

It does actually work reasonably well at the end of the day. Any representative that you are put in contact with will be specifically trained in the area of law that you require assistance for. Moreover, very often they will have higher education legal qualifications or work related experience that will make them ideal to deal with your case. They are great at giving the right image and costumer service which is sometimes where solicitors fall down.

If you do live in a larger city though and there are a number of law firms in your area that take on legal aid clients, why not try using a good UK solicitor directory in order to decipher which firm has been rated the highest by their previous clients? This is a really good way of making sure your case will be dealt with professionally and in keeping with your expectations. Solicitor.info is a fabulous website where you can rate legal solicitors in the UK and also read what others have said about them.

When should a Lawyer be appointed?

Thursday, July 30th, 2009

Legal cases are often lengthy, protracted and not something to be entered into lightly. This article looks at why it is Essential to find a solicitor as soon as you think you have a case and some of the things you should look for when choosing a solicitor to help through the process.

If you think that you have a legal case, then it is vital that you consult a solicitor at your earliest opportunity.Solicitors will not take on every case, despite what you may of heard. If you consult a Lawyer, but they feel that you do not have a case, or it is so weak that success may be unlikely, then they will tell you, so that you do not waste your time progressing a case that is doomed for failure.

Many solicitors offer a fixed, free interview, or if you consult over the Internet, you can get a brief response via email.  Here the solicitor will tell you whether or not you have a legal case and it is worth proceeding.

So there is little point in just thinking about whether you have a legal case: you need to ascertain the facts. Often there can be timescales associated with litigation, so you need to be sure that you comply with these timescales: otherwise you could have a case, but it may be out of time, in which case there is no point proceeding.

It is important to find a solicitor with some expertise in the field on which your case focuses. Many Lawyers, for example, will specialise in areas of law such as wills, divorce or house buying.  Ascertaining which solicitors deal specifically with a particular area can be easily done, through a quick Internet check or consulting the solicitors directory.

Finding a solicitor should also be about finding someone that you feel comfortable and at ease with.If you do not feel good with a particular solicitor, there are many others to choose from, so find one you are happy with.  They will be the person to fight for your rights, so there has to be a basis of trust and understanding there.

And don’t forget that a good solicitor will pay for themselves many times over, so as soon as you think you have a case, do not delay: see a solicitor and find yourself a good one!

How To Find the Best Solicitor in the UK

Wednesday, July 29th, 2009

When you want to find a good solicitor, here in the UK, there are too many Solicitors directories to mention. One thing that they all seem to have in common, however, is that they all mainly seem to be quite basic sites where you can search for a firm in a particular location.

Often you will be able to stipulate the specific area of law you require a solicitor’s help with, but that will pretty much be the extent of things. In fact, with all of this in mind, you may as well just pick up a copy of a local telephone directory. This will tend to contain the same amount of information as you will find through these sites.

Corporations of solicitors will usually pay the solicitors directory to be admitted, in them. Therefore, this will be an advertising venue that will be intended to promote the firm. Lawers are in this to make money and are in compertition with one another.

This is all very well, but obviously in terms of information relating to the way in which a firm of solicitors will be able to deal with your case, this is of no use to you whatsoever. Firms will be able to put themselves in any light, through these directories, and there will be nothing available to the potential client that will inform them of the firm’s skill to deal with their case. Basically, this is pointless!

Finding a solicitor through such directories can be a very frustrating process. How do you know which are good and which are bad?

Sadly you might find that some soliciotrs do not like giving a great level of service. Let alone good customer service. They can often be very ‘no nonsense’ and if you ever dare to question them over an aspect of their service, stand well back and wait for the fireworks. As a general rule, they do not like being questioned and it is my own personal experience that they can often get very nasty if you complain over even a very simple issue.

In today’s society though, we are probably all agreed that this simply is not acceptable. We need a place that will tell us the truth about the soliciotrs we are thinging of employing.

Hence, this is the very reason why a new breed of solicitors’ directory was conceived. The fundermental drawbacks of directorys where looked at and they have been taken to the next level. When we have cause to utilise the services of a solicitor, they usually command quite extortionate fees for the privilege. Thus, they must be ready to prove to clients they are suitable to do the work.

Rate a solicitor type places are entirely aimed at helping you to ascertain this very information. If a client has been treated badly, you are encouraged to make a note of this through such websites. Such firms of solicitors will not deserve more work if they are not able to adapt their attitude in line with the present.

On the other hand, it is equally important to recognise the firms that have delivered excellent customer service. A rate your solicitors’ directory will be intended for exactly that and we would love to see such companies receiving extra business through this site as a consequence.

Making An Accident Claim: What Is The Process?

Friday, July 10th, 2009

Reputedly, accident claims are now widespread, but they are still complex legal cases and people need to be aware of the different types of accident claims and the complexity of these claims. These differences which occur in the process of litigation are explored in this blog.

Making an compensation claim is much more straightforward than it used to be. This means that you can look forward to the whole process being a lot speedier than before, although it can still take much longer than you may initially have thought.

Firstly, you need to find the best solicitor in order to make an accident claim. Find a good solicitor with whom you can communicate and whom you trust and then let them guide you through the exact process.

Various types of claims exist because there are so many different types of accidents that people can have; that’s why there are no hard and fast rules.

For example, you would claim against your local authority should you fall on the pavement due the negligence of its’ maintenance.  But if you slipped at work or your employer did not provide you with protective equipment that led to an accident, then you are making an employment based accident claim.

If you were injured by either a motorcar or motorbike then you would be, on the other hand claiming about a road traffic accident.

Each type of accident claim has its own peculiarities and two claims made in the same category may not be the same.  For example, an employment claim may be settled very quickly, if your employer manages to reach an agreement. It can take much longer however, if your employer resists the case and decides to fight it all the way.

Basically your solicitor or lawyer will be the person to advise on all aspects of your accident claim and don’t be shy about asking for advice, law firms are used to this. Timescales for gathering evidence and making a claim may be in place; this is important to note. Hence find a solicitor as soon as you can, to ensure that the process can be as smooth and hassle free as possible.
